Most people consider this [taking photos of others without their permission] all good fun and games. If someone wants to take a camera-phone shot of their own privates or the fishbowl on their desk, so be it. But if the phone is company-owned and it's being used for risky or even illegal behavior, who's liable?...
The company, however, is in a gray and potentially scary situation. Since it paid for the plan and phone, the company could be liable and end up getting sued, especially if Joe Employee used the phone to photograph women at the office and posted those images online...
