Changes to PayPal User Agreement

Effective Date: May 18, 2006
Beginning May 18, 2006, PayPal will introduce an online dispute resolution platform which will (among other things) amend the procedures applicable to buyers filing a claim under the Buyer Complaint Policy, the PayPal Buyer Protection Policy, the Buyer Protection Policy for eBay Express, and the Buyer Credit Policy. Prior to filing a claim (which will be determined under the terms of the applicable policy), buyers will first be required to file a “dispute” with the seller via the PayPal resolution center. By filing a dispute, buyers and sellers will be given a period of up to 20 days to settle the matter prior to a claim being filed. This period of time allows buyers and sellers the opportunity to settle the dispute and to resolve any potential claims between themselves prior to a claim being made. The deadline for filing a dispute with a seller is 45 days following the date the disputed transaction took place. A claim relating to a dispute will have to be actively filed within the 20 day timeframe made available, otherwise the dispute will be closed and no claim will be permitted to be made for that payment transaction. Amendments will be made to the terms of the Buyer Complaint Policy, the PayPal Buyer Protection Policy, the Buyer Protection Policy for eBay Express, the Buyer Credit Policy, and the Seller Protection Policy to reflect this change in the buyer complaint process. This amendment to the buyer complaint process does not apply to claims made by registered German buyers.

Amendment to the PayPal MasterCard ATM/ Debit Card User Agreement
Notice Date: April 19, 2006
Effective Date: May 18, 2006
Beginning May 18, 2006, the eligibility requirements for the PayPal Preferred Rewards/1% cashback program will be changed. To be eligible for PayPal Preferred Rewards you will have to complete the following: (1) Obtain and activate a PayPal Debit Card, (2) Provide your business information, (3) If you list items for sale on eBay, turn on the PayPal Preferred Preference for all your eBay listings and show PayPal as the only online payment option that you advertise, and (4) If you sell items on your own Website or on a marketplace other than eBay, promote PayPal as your preferred payment option.

Policy Amendment
Notice Date: April 19, 2006
Effective Date: May 18, 2006
Beginning May 18, 2006, when a buyer files a claim for a significantly-not-as-described item (or when a buyer files a claim under the Money Back Guarantee Policy after receiving the merchandize), in some circumstances, we may require the buyer, at his own expense, to send the item to PayPal, to a third party as we direct the buyer or to destroy the item (if for example we receive evidence that the item is counterfeit). This amendment will not affect the seller’s responsibilities under these policies.The following policies will be amended: PayPal Buyer Protection Policy, Buyer Credit Policy, Buyer Complaint Policy, Buyer Protection Policy for eBay Express and Money Back Guarantee Policy.

Updated the Privacy Policy for U.S. users to include reference to the fact that we may ask you for a person’s telephone number when you wish to send them funds or request funds from them and also that a registered user’s telephone number may be disclosed to other PayPal users as part of their use of the PayPal service. Added a new PayPal Mobile Policy for U.S., UK, and Canada. Added a new Buyer Protection Policy for eBay Express for U.S. Modified the Eligibility section of all versions of the PayPal Buyer Protection Policy. Added a note regarding waiver of proof of shipment to Section 5 of the Italian version of the PayPal Buyer Protection Policy. Updated the UK version of the Closing Accounts and Limiting Account access policy to include the ability of PayPal to limit the PayPal account if you have abused the Buyer Complaint process. Added Section III, Deferred Payments, to the UK, German, French, U.S., and Rest of Europe versions of the Payments (Sending, Receiving, and Withdrawals) Policy. Updated the U.S. version of the Risk Controls Agreement. Added information about backup funding sources to Section 4.2 and added Section 3, Linking a Backup Funding Source to your ATM/Debit Card, to the U.S. version of the PayPal MasterCard ATM/Debit Card User Agreement. Removed reference to eCheck and added Section 8, Protective Actions, to the U.S. version of the PayPal Payments Pro and Virtual Terminal Agreement. Updated Section 6 of the U.S. version of the Premier and Business Account Policy. Updated Section 3.3 of the U.S. version of the Buyer Credit Policy. Added Section I.2, Default Funding Sources, to the U.S. version of the Payments (Sending, Receiving, and Withdrawals) Policy. Clarified Section 2.1 regarding use of Pooled Accounts of the U.S. version of the User Agreement. Updated Section 6.5 of the U.S. version of the User Agreement. Removed reference to American Express Corporate card from the U.S. version of the User Agreement. Updated Section b of the UK version of the Fees Policy to reflect fee changes. Updated Section 4.4, Buyer Responsibilities, of the UK PayPal Buyer Protection Policy regarding faxing proof of shipment. Added Ladbrokes Pls as an approved operator to the Gambling Policy for UK, Germany, Austria, Belgium, Italy, Spain, and Rest of Europe.

...and alienate my off-ebay customers who when given a choice between using PayPal or their credit card overwhelmingly (95%+ on our web sites, over 80% on Overstock) choose credit cards? Ha, ha, ha, ha, I'll be rushing to plaster PayPal preferred logos on everything to comply with this new policy...NOT  :Smile
