Alskling, dead on again. I was wondering about his use of the word post. Those are the same policies he has for the forum. The policy would also have to state that PM are monitored. You have to state that in your policies. His interception of PM's from a buyer to a seller is business interference because the seller had no idea that their PM's were read and responded to by Ray. How can the seller conduct a transaction if these emails are randomly hijacked?  Pottytrain5

Let's ask BBH or Regic about the legality. TT has a PM system in place, maybe they would know.
[/quote]

He may have protected himself enough with his PM policy to do it legally, but it is sleazy/a violation of privacy/not accepted behavior/frowned upon, etc, etc.  Many companies do monitor their employees email/email within their corporate network.

Thank Regic. But sellers are not employees. It is closer to the other way around. They pay for the service which makes them clients.

Yes most businesses do monitor emails in the workplace. However you usually sign a disclosure agreement, and are notified in writing that any electronic mail that is sent or received on a company computer belongs to the company. The PM system however is being accessed from your own personal computer. The use of the PM system through WP by sellers is a feature that a seller is paying for be it FVF or store fees.

Exactly. Poppers are PAYING members. PM forwarding is a service. Even FREE services, like HotMail know the law. Poppers paying to have their own PMs interrupted and censored? THIS IS ABSURD! Plus, as Chiquita said, members of WP are NOT employees. Furthermore, I don't care what the policy says, I BELIEVE IT IS ILLEGAL AND UNCONSTITUTIONAL. These are PRIVATE, PERSONAL messages. It doesn't matter if Poppers agree to it or not. THAT DOESN'T MAKE IT LEGAL or CONSTITUTIONAL. Any more than a 13-year-old girl agreeing to have sex with her father makes it legal or agreeing to get life in prison without due process is constitutional. WP regularly violates its own policy by sending emails to members that are clearly disruptive, harassing and threatening in nature.

Ray sees himself as above his members and the law. Simple as that. HIs comment on another thread "this is my business, and I'll run it however I want, and if you don't like it you can hit the bricks," says it all.

YYNA --  Smileywelcome Smileywelcome It's about frickin' time. I'd almost given up. I remember you from when I was there and I believe we shared a PM or two. Welcome to TT. Your posts will not get censored, we promise. We also promise not to slap your hand and send you "warning" emails should you disagree (either intentionally or inadvertently) with any poster here. We will not excommunicate you because you might pose a question related to your business (perish the thought). And, as hard as it might be to believe right now, independent thinking is OK. It really is. Scout's honor. And we promise not to intercept your personal messages and forward only those that glorify us and tell the world that we're every seller's dream board. Promise.

Re: Wagglepop 2: Deja Vu as Auction Site That Left Sellers Stranded Reopens
Hi Guys!  Haven't been around in a couple of days since I got better and have been back at work!  Anyway... WOW lots happening... where do I start??

OK... #1... my WP demise date will be August 1, 2007. I say this because it it as the end of the projected date range for their marketing plan... Karay will no longer have excuses for not spending the $$ and will close his doors and run! Bootyshake Bootyshake Bootyshake

#2... the whole deleting PM's thing just pisses me off!  Violent1 And the fact that yyna(sp?) got the boot too for having a legit grime really grinds my gears! Pain10

And D... The stores are dropping like flies and I am glad glad glad!!  I am shocked that the boards have gotten so strict that you can't post unless it a prayer, a kumbaya or a kiss-ass pucker for Ray's butt!!!

Munky2

edit: that should have said gripe... not grime!!!  LOL I need wine!

That will teach me to go to the grocery store!

Smileywelcome yyna - we have been waiting to welcome you.  Post as much or as little as you like.

Don't pay the bill - they don't have a legal department  Laughing7

Don't feel bad, I've been banned, too, but I'm on my 4th ID so I'm still lurking.  I do so want to stir the pot soon, though.  Somebody needs to start thinking up a 5th name for me.  Toothy9
