Being in the graphic design business myself, copyright and trademark ALWAYS belong solely to the creator of whatever design - including web banners, web pages, sites, etc. Only usable with permission unless the design has been sold to you without restrictions.

This is a long and very complicated subject that I HAVE researched thoroughly because of the home business I ran for over 10 years - I've condensed it a LOT and made it very basic to understand, but any and all designs ALWAYS belong exclusively to the designer until they decide to sell them. Any use without or against the designer's permission IS punishable by law.

ETA: Forgot to agree with Rat - designs do not have to be registered to be trademarked or copyrighted (2 different things totally).
