Forums, Articles, and Copyright Infringement
I was reading at another forum, and I noticed that there were many articles that had been posted, retrieved from various sites on the web. The articles were posted in their entirety, the authors were given credit, and in some instances, no link to the original article was provided.
1. I may be wrong, but don't most blogs, magazines, ezines, newspapers, etc.., allow you to reprint only a portion of the article? 2. Don't they also require a link back to the original article? And, even with a link back, I think it would still be infringement if you post the full text? Assuming that their copyright states "All rights reserved". I know that's what many bloggers require, from having reading their copyright info. That's also what I require on my blogs. Just curious and a little confused......copyright infringement annoys|angers me on many levels. Edit to change the title. |

A portion with a link back is generally considered fair use and is allowed by most writers. Reprinting the entire article and not linking generally would be considered copyright infringement not fair use unless the writer or publication has given permission for the article to be republished.

Thanks, Regic. That's what I thought. In some cases, they linked back, but in others they didn't. In all cases, they published the entire article.

After doing a little research, primarily on xxWikipedia, it seems to me that according to the factors that they take in to account in determining infringement, publication of the full work|article as an article, would be a derivative work. At least in this case.
At least if they determine that publishing the whole work again has NOT contributed to the betterment of society in any way, <----- I'm convinced it's derivative. |
