If any of the following conditions are met then the manual is considered to be in the public domain and can be reproduced without getting permission from the original author:

1st publication date was:
a) Pre 1925
b) 1925-1979 and manual was published without © notice
c) 1925-1965 and manual was published with © notice but copyright was not renewed after 28 years
d) 1978-March 1, 1989 and manual was published without © notice and copyright was not registered with US copyright office
e) 1st published after 2002 but created prior to 1979 and author died more than 70 years ago

In 1988 the US adopted some international copyright conventions (the Berne Convention Implementation Act of 1988) and so everything published after March 1, 1989 is copyright protected regardless of whether the publication has a © notice and regardless of whether the copyright was formally registered
Most of those manuals are available for free online and several of the older manuals are in the public domain but the manual in this listing: http://www.plunderhere.com/Murray-Lawn-T...17708.html (which is also available for free on the manufacturer's website) isn't public domain.  The  387002x92a manual isn't dated and there isn't a copyright notice on it, but this model was made around 2004 so the first publication date for the manual would have been about the same time and therefore the manual is automatically protected by the 1988 copyright law revision even though there is no copyright notice on the manual. You can't create a derivative work, i.e., a CD copy of the entire original copyrighted work, and sell it without the author's (the manufacturer) permission ...although dozens of eBay, iOffer,  and RinkyDinkBid sellers are selling CD copies of this same manual. 

Some idiot who mistakenly thinks everything without a copyright notice is in the public domain is obviously selling a "start your own repair manual resale business- 500 repair manuals with resale rights" DVD and equally clueless sellers are buying it and reselling the manuals.

That's a civil suit.  Counterfeiters can also be charged with a criminal offence.

I think the copyright laws should be amended  to include penalties  for buyers who knowingly buy counterfeits.  There's a thread over on PSU today which illustrates why some buyers should also be subject to fines.

synopsis: a) buyer feels she was ripped off by a seller because the quality of the counterfeit Louis Vuitton bag she bought from him wasn't as good as the quality of other counterfeit LV bags she has bought. b) the buyer buys counterfeits as a way of getting back at Louis Vuitton because she feels they are committing a crime against humanity by charging too much for their bags.

Last month Liberty Media filed a $10 million federal lawsuit against 51 eBay sellers who were selling pirated adult DVDs.  The lawsuit also "lists "John Doe" defendants who may have bought the pirated DVDs"

The auction site owner was right. The fisherman was wrong.  Hey Ray, if all of those copies of PHP Pro Bid on your sites were legal copies of the script you would know that Pro Bid has always charged for installation.

Sales off to a brisk start on aSs this year. The site has grossed $281 in 5 days, for a total of a whopping $1 per store per day.
This propagandistic troll sold over $300 all by myself yesterday.
So $1 a day isn't awful. Everyone has to start somewhere!  Thumbsup
